Frequently Asked Questions:  Guardianships

WHAT IS A GUARDIANSHIP?
A guardianship is a legal relationship in which the court appoints someone to take care of the person, or assets, or both, of a minor.

CAN I DESIGNATE SOMEONE TO BE THE GUARDIAN OF MY CHILD IN THE EVENT SOMETHING HAPPENS TO ME?
Yes. You can nominate a guardian for your children in your will. The nominated person can then seek to have the court appoint his or her as the guardian of your children.

CAN A GUARDIANSHIP BE ESTABLISHED IF A MINOR'S PARENTS ARE STILL LIVINGS?
Yes. A person can consent to have a guardian appointed for their children. Alternatively, if the court determines that the minor's parents cannot take care of the minor the court may appoint a guardian for the minor.
